Reciprocidad de inversión extranjera, análisis de su afectación al TLCAN

Abstract

Ciertos países han considerado el condicionar la apertura de la inversión extranjera a la reciprocidad por parte del país de donde provenga la inversión extranjera, situación de iure que podría ser discriminatoria y violatoria del derecho internacional. Si bien es cierto que los países pueden restringir la inversión extranjera, las restricciones deben ser realizadas a priori, concordantes con los demás principios contenidos en los tratados y otorgadas o restringidas de forma idéntica a todos los socios comerciales del país que restringe. Por consiguiente, tomando como referente el Tratado de Libre Comercio deAmérica del Norte (TLCAN), Estados Unidos, Canadá y México, podrían liberar la inversión extranjera, pero no podrían solicitar reciprocidad, toda vez que la misma puede significar una discriminación entre las partes y violar los principios rectores del derecho internacional.
