Externalidades: más que un problema de derechos de propiedad

Abstract

La definición de los derechos de propiedad permite que el titular del derecho,respaldado por la norma, se apropie y explote, transfiera o done un recurso.Quien ejerce esa titularidad es responsable del uso que se dé al mismo, elque no solo debería beneficiarlo, sino también procurar por lo menos nodeteriorar el medio ambiente, que es el que recibe todo el impacto del usoque se ejerza sobre dicho recurso.Considerando que el aprovechamiento de esos recursos puede generar externalidadesnegativas, es decir, que la decisión individual sobre el uso delrecurso afecte a un tercero, ajeno al proceso, y este último no sea compensado,convirtiéndose en un fallo del mercado; se buscan soluciones quepermitan internalizar la externalidad por medio de controles voluntarios osancionables, dado además, que el otro afectado es el medio ambiente.
