El Estado unitario descentralizado: Una crítica del enfoque constitucional colombiano

Abstract

Este artículo arguye que la Constitución colombiana de 1991 no contiene mecanismos apropiados para articular las dimensiones unitarias y descentralizadas del Estado. Esta circunstancia afecta adversamente la democracia y obstaculiza el logro de los fines últimos del Estado. El bicameralismo puede servir de vehículo para garantizar el balance de poderes nacionales y territoriales. El artículo muestra que con las reglas de juego actuales difícilmentecabe esperar que el Congreso colombiano cumpla el papel de fomentar la cooperación para gobernar entre las mayorías y las minorías, espacialmente definidas. Se arguye que la Constitución de 1991 exhibe serias deficiencias de concepción que hacen improbable un tránsito sin traumatismos hacia un Estado Regional, al margen de si la idea de Estado Regional es o no una buena idea.
