66 Years of the Chicago Convention on International Civil Aviation - New Trends in the International Law of the Air

Abstract

The international law of aviation (law of the air) is one of the most dynamic fields of public international law. The Chicago Convention on International Civil Aviation dates back to 1944, and is still the fundamental set of rules regarding the use of air territory of the states. However, a growing number of bilateral, multilateral and regional agreements dedicated to the civil aviation, especially international air transportation, must be taken into account. What used to be called a “Chicago system” has turned into the “Chicago-bilateral system” and the principle of absolute sovereignty of the state in its air territory has been greatly modified in the inter-state agreements by variety of freedoms of the air.
