Minimum Wage and Collective Bargaining: A Possible Combination

Abstract

Questo saggio si propone di affrontare il tema dell’introduzione di un salario minimo legale, e di renderlo compatibile con l’impianto giuridico, istituzionale e contrattuale presente in Italia, attraverso un’analisi economico-giuridica e una riflessione sull’interazione tra il trattamento retributivo inderogabile e il ruolo svolto dalla contrattazione collettiva nel nostro ordinamento giuridico. Formuleremo una proposta ai fini del riconoscimento di un salario minimo garantito per i lavoratori, in grado di coniugare l’efficacia della fonte collettiva, quale fattore di regolazione tra i lavoratori e tra le imprese, e il sostegno offerto dalla fonte legislativa. Discuteremo le recenti iniziative promosse in seno all’UE in tema di salario minimo, e ne valuteremo l’impatto sul sistema italiano sia in termini economici che in termini giuridici
