The Workers’ Statute 50 Years Later: Between Preserving and Updating

Abstract

Il contributo, dopo aver evidenziato l’esigenza di estendere, alla luce della mutata realtà economico-sociale, le tutele minimali trasversali previste dallo Statuto dei Lavoratori oltre la sfera del lavoro subordinato, si interroga sulla necessità di aggiornarne e integrarne i contenuti per garantire una tutela ai lavoratori non solo nell’ambito del rapporto ma, in generale, nel mercato del lavoro. A tal fine, viene ipotizzata l’attribuzione ai lavoratori di un diritto all’identità professionale del lavoratore. Il contributo si interroga, inoltre, sulla necessità di prevedere criteri di verifica della rappresentatività sindacale per far fronte alla proliferazione dei soggetti e dei contratti collettivi e per garantire quell’anima promozionale dell’azione collettiva che è propria dello Statuto dei lavoratori.
