Past, Present, Future. The Workers’ Statute 50 Years after Its Approval

Abstract

Ripercorse le vicende normative che, negli ultimi 50 anni, hanno inciso sulle previsioni dello Statuto dei lavoratori, il contributo mette in luce la necessità di valorizzare l’autonomia collettiva attraverso un quadro organico e stabile di regole. Valorizzazione che andrebbe perseguita attraverso politiche legislative, questa volta non a sostegno del sindacato ma del sistema delle relazioni collettive nel suo complesso. Tale intervento dovrebbe, da un lato, rafforzare la rappresentatività delle parti sociali e, dall’altro, dare attuazione alla previsione costituzionale di efficacia erga omnes dei contratti collettivi, per far fronte ai fenomeni di dumping legati alla diffusione dei cosiddetti “contratti pirataµ. Il contributo auspica, infine, la diffusione tra le parti sociali di una cultura in linea con la prospettiva di valorizzazione della loro responsabilità, consapevole che, solo in questo modo, l’intervento normativo potrà rivelarsi realmente utile.
