La concurrence normative transnationale

The author presents the normative ?competition? that defines transnational law, i.e. the descriptive study of the practice of law professionals who compare the standards in competition, examine the concrete effects of their possible application, and choose these standards through law choice techniques and thus constitute the great ?normative spaces? of transnational law. Two concrete examples are used to show the descriptive power of the new theory of normative spaces: the major Senegalese oil and gas contracts and the new ecological concessions in the Indian Ocean. Indeed, we will first of all describe the techniques of the lawyers at work in these normative constructions. Then, we will see how the theory of transnational law can be renewed, in particular the concepts of transnational state and global constitution.
