Les fonctions de la procédure en droit européen de la concurrence

Abstract

The present paper reviews the evolution of procedural rules in modern EU competition law. We observe a dual movement. On the one hand, there is an increase in the procedural constraints bearing on competition cases. On the other hand, procedural shortcuts keep being introduced, driven by the demand of competition authorities to bring cases to faster remediation. This somewhat contradictory evolution can be rationalized by the existence of a tacit ?regulation contract? between parties to competition proceedings and the competition authority itself.
