Le logiciel libre et les communs. Deux formes de résistance et d’alternative à l’exclusivisme propriétaire

Abstract

This article is about the various connections between the free software movement created by Richard Stallman, the Anglo-Saxon lawyers defending the public domain (Lawrence Lessig, James Boyle, Yochai Benkler, etc.), and the scholars working with Elinor Ostrom. We recount how these three groups of actors met in the beginning of the 2000s and try to explain what was at stake in their encounter: the elaboration of a general theory of the commons, reaching beyond the differences between physical and digital commons ; the construction of an alternative to the hegemony of private property. We further elaborate on these questions by considering property as a bundle of rights, and we study the examples of the General Public License and of the Creative Commons licences to analyze the alternatives to exclusive property that have emerged.
