Les jeux de procédures en droit français des pratiques anticoncurrentielles

Abstract

L'analyse en droit français des jeux de procédures des pratiques anticoncurrentielles – entendus comme les interventions distinctes ou concomitantes de l'Autorité de la concurrence et du juge judiciaire - est au confluent de trois concepts centraux développés par l'École de Nice : droit économique, ordre concurrentiel et pouvoir normatif. Le droit économique, tout d'abord, comme l'a démontré Gérard Farjat, dont le droit de la concurrence constitue un sujet d'étude privilégié, spécialement depuis la promulgation de l'ordonnance du 1er décembre 1986. L'appréhension et la compréhension de la concurrence ne peuvent s'opérer sans le recours à l'analyse substantielle propre au droit économique.
