Faut-il repenser la politique de la concurrence sur les marchés internet ?

This article aims to understand whether or not Internet-related markets require a specific treatment and attention by antitrust authorities. Through several recent French and US antitrust cases, I emphasize the main challenges faced by competition authorities. The first challenge concerns the appreciation of concerted practices and agreements that are widespread on Internet-related markets. Secondly, how should antitrust authorities treat dominant positions, knowing that Internet-related markets are highly subject to monopolisation ? The last challenge concerns merger control since Internet-related markets are characterized by a high degree of uncertainty and immaturity. This paper states that Internet-related markets do not require to change antitrust law, but simply to enforce existing antitrust law more carefully than on traditional markets.
