Enseigner le droit dans une formation à la création d’entreprise. Proposition d’une approche par la problématisation

The law is a major element of any project of new business start-up. But law is complex and hard to understand for students in entrepreneurship. So, how can we teach the law in an entrepreneurship cursus ? We followed ten classes in a program dedicated to new business start-up. Our analysis underlines the difficulty of the students to question legally their project. To address this difficulty, we propose a model which emphasizes the learning of questioning by problematization. This model centers on the identification of the main relationships between the project and its most important subjects and objects. For each relationship, management issues are raised. For each management issue, the legal answers are considered. The purpose of this model is to teach to the entrepreneurs to raise themselves the good legal issues of their project.
