14. Criminalité organisée et gouvernance : l'exemple de la prostitution

Abstract

The issue of prostitution is an old and current concern for which public policies have differed over time and across countries. Debates put nowadays facing two opposite ethics, dignity versus freedom, between groups that are more or less affected by regulations. This article addresses the legislation on prostitution and seeks legal solutions to lower the harmful effects of prostitution. After recalling the theoretical framework of the New Institutional economics (Williamson, 1975, 1985, 1994), it applies a comparative analysis to modes of governance of transactions in the field of prostitution services. The article concludes with a few comments about transactions of others legal or illegal goods or services such as alcohol, cigarettes and drugs.
