Le droit de la mer, régulateur des crises pour le contrôle des espaces et des ressources : quel poids pour des États en développement ?

Abstract

Many disputes between States are specific. They deal with spaces and resources linked with marine ecosystems and activities, and require a special Law : International Law of the Sea. This one, firstly divides States rights on marine spaces, but has another role since 1950 : the regulation of marine crisis, disputes, and wars, for the access to coastal spaces and to maritime areas, up to the high Sea. Rules have been increasing, proposing legal solutions for natural resources disputes. They have been applied by a growing number of States, institutions, and jurisdictions. After a period of developing countries influence in the settlement of a Law which gives strategic means, does not the share of ?developing States? disappears for the benefit of maritime States henceforth gathered with environmental or fisheries references rather than developing references ?
