Vzťah medzinárodného a európskeho práva na príklade bilaterálnych investičných zmlúv členských štátov EÚ

Abstract

Bilaterálne investičné zmluvy predstavujú významnú súčasť medzinárodného práva a v podmienkach členských štátov Európskej únie aj sféru, ktorá je príznačná rozhodujúcim vzťahom s európskym právom. V príspevku poukazujeme na medzinárodnoprávnu povahu bilaterálnych investičných zmlúv ako foriem podpory a ochrany medzinárodných investícii, zvýrazňujeme ich pozíciu v kontexte uplatňovania európskeho práva – najmä pravidiel Spoločnej obchodnej politiky a voľného pohybu kapitálu a analyzujeme problematické ustanovenia bilaterálnych investičných zmlúv. V závere analyzujeme čl. 307 ZES ako rozhodujúce ustanovenie upravujúce vzťah medzinárodného a európskeho práva v spojení s problematikou bilaterálnych investičných zmlúv členských štátov EÚ. Príspevok bol vypracovaný v rámci riešenia grantovej úlohy VEGA 1/4563/07 „Vzťah medzinárodného a európskeho práva“.
