Medzinárodné utečenecké právo a nelegálna migrácia

Abstract

Svet sa radikálne zmenil od vzniku úradu Vysokého komisára OSN pre utečencov (UNHCR) a od nadobudnutia platnosti Dohovoru o právnom postavení utečencov, ale aj napriek tomu aj naďalej tvoria základný rámec ochrany. Úrad Vysokého komisára OSN pre utečencov bol založený s cieľom pomôcť utečencom, ktorí boli v dôsledku druhej svetovej vojny vysídlení zo svojich domovských štátov a jeho mandát bol obmedzený na obdobie troch rokov. Milióny ľudí je nútených utekať pred prenasledovaním z vlastnej krajiny aj v súčasnej dobe, pričom UNHCR aj naďalej pôsobí v tejto oblasti. Dohovor o právnom postavení utečencov tvorí právny nástroj ochrany na medzinárodnej úrovni a predstavuje akúsi „utečeneckú listinu práv a povinností“.
