Práva Pôvodných Obyvateľov Fínska: The Nellim Case

Abstract

The Nellim case predstavuje komplexný súbor problémov, ktorým čelí Fínsko a súčasná sámska komunita žijúca na jeho území. V spore sa prelína dlhoročný konflikt Sámov a štátnej spoločnosti Metsähallitus týkajúci sa ťažobných aktivít v lesoch na území, ktoré Sámom tradične patrilo a ktorý mal príčinu v ďalšom aspekte sporu – rozhodnutí správnej jednotky, družstva Ivalo Reindeer Herding Cooperative, o porážke celých sámskych stád sobov. Pre sámskych pastierov sobov bolo toto rozhodnutie likvidačné a predstavovalo koniec ich tradičného spôsobu života. Po vyčerpaní všetkých vnútroštátnych právnych prostriedkov ochrany sa obrátili na Výbor OSN pre ľudské práva, ktorý však prekvapivo rozhodol, že nedošlo k porušeniu ich práv. Článok analyzuje všetky dôležité aspekty, ktorých sa Nellim case týkal.
