Prvé Interpretácie Ex Post Facto Klauzúl Ústavy Spojených Štátov Amerických

Abstract

Jedným zo základných pilierov právneho štátu je právna istota. Dôležitou súčasťou tohto konceptu je zákaz retroaktivity. Ústava Spojených štátov amerických v ústavnom texte vytvorenom v roku 1787 z istej časti zákaz retroaktivity obsahovala prostredníctvom dvoch ex post facto klauzúl. Význam tohto latinského slovného spojenia však nadobudol presné kontúry až prostredníctvom interpretácie Najvyšším súdom Spojených štátov. Sudca Samuel Chase v roku 1798 definoval štyri kategórie nedovolených legislatívnych aktov. Na to, aby bol zákon uznaný za protiústavný ex post facto, musí spadať aspoň pod jednu z nich.
