Tendenzen im Genossenschaftsrecht - weltweit: Tendencies in cooperative law - worldwide

Abstract

Der Beitrag konzentriert sich auf die Tendenz, die anerkannten Genossenschaftsprinzipien in Recht umzusetzen und fragt, ob es eine diesbezügliche Rechtspflicht gibt. Er bejaht dies aus dem Völkerrecht. Aus organisationsrechtlichen Gründen und um die Genossenschaften zur Verwirklichung des Völkerrechtskonzepts der nachhaltigen Entwicklung zu befähigen, bündelt der Beitrag die Genossenschaftsprinzipien zum Prinzip der demokratischen Mitgliederteilnahme, -teilhabe und -kontrolle. Schwierigkeiten bei der Umsetzung dieses Metaprinzips in Recht ergeben sich insbesondere daraus, dass sich Genossenschaften zu komplexen Gebilden fortentwickeln und sich durch fortschreitende Integration in Wertschöpfungsketten und Netzwerke „deorganisieren".
