Abstract

Der Beitrag skizziert die eingangs erwähnten Entscheidungen des Verwaltungsgerichts Hannover und des Oberverwaltungsgerichts Lüneburg, in denen es um die kommunalverfassungsrechtliche Zulässigkeit der Beteiligung einer Kommune an einer Fernwärme- und Breitbandnetzgenossenschaft ging. Nach einer kurzen Darstellung des Sachverhalts und der gerichtlichen Argumentation werden die Entscheidungen anhand der klassischen Auslegungsmethoden einer kritischen Bewertung unterzogen. Im Schlussteil werden die sich aus der Rechtsform der eingetragenen Genossenschaft ergebenden Besonderheiten, insbesondere im Vergleich zu den klassischen Kapitalgesellschaften, beleuchtet.
