Der Rückzahlungsanspruch der Inkassobank nach Verfugungen über vorläufige Scheckgutschriften

Abstract

Nimmt ein Kontoinhaber nach vorläufiger Scheckgutschrift eine Abhebung vor und wird die Scheckeinlösung anschließend verweigert, dann stellt sich die Frage, auf welche Grundlage eine Inkassobank den Anspruch auf Rückzahlung stellen kann. Das bislang höchstrichterlich nicht geklärte Problem war Gegenstand der Entscheidungen des OLG Hamm vom 28.6.1995 und des OLG Bremen vom 18.9.1990. Die Urteile beruhen auf dem gleichen rechtlichen Ausgangspunkt, sind aber im Ergebnis gegensätzlich. Sie geben Anlaß, den Problemkreis unter besonderer Beachtung der Auslegung schlüssigen Verhaltens und der Aufgabe, die das Abstraktions- und das Trennungsprinzip der Leistungskondiktion gestellt haben, zu untersuchen.
