Abstract

Im Kreditkartengeschäft hat sich die Frage, ob der Karteninhaber bei Mängeln des Valutaverhältnisses seine in Gestalt des Leistungsbelegs erteilte Zahlungsanweisung gegenüber der Kartenorganisation widerrufen kann, zu einem Problemschwerpunkt entwickelt. Entgegen bisherigen Ansätzen läßt sich die Frage widerspruchsfrei nur dann beanworten, wenn auch das Vollzugsverhältnis zwischen Kartenorganisation und Vertragsunternehmen, insbesondere die sogenannte Rückforderungsklausel, mit in die Betrachtung einbezogen wird. Deutliche Widersprüche zwischen den AGB-Regelungen der einzelnen Vertragsverhältnisse zeigen sich insbesondere bei den Kartenorganisationen, die im Vollzugsverhältnis einen Forderungskauf vereinbart haben. Ein stimmiges Gesamtsystem des Kreditkarten- Verfahrens kann hier nur dann entwickelt werden, wenn eine Qualifizierung entgegen dem Wortlaut vorgenommen wird.
