Die Großkreditnormen des § 13 KWG nach der Fünften Novelle des Kreditwesengesetzes

Abstract

Am 31. Dezember 1995 ist in der Bundesrepublik Deutschland die Fünfte Novelle des Kreditwesengesetzes (KWG) in Kraft getreten, in der die Großkredit-Richtlinie und die Konsolidierungs-Richtlinie der Europäischen Union (EU) in deutsches Recht transformiert worden sind. Zunächst werden die wesentlichen Änderungen des Kreditwesengesetzes aufgrund der Fünften KWG-Noveüe in einem Überblick dargestellt. Die Änderungen, die sich aufgrund der Fünften KWG-Novelle für die Großkreditnormen des § 13 KWG ergeben haben, werden in diesem Beitrag detailliert erläutert. Weitere wesentliche Änderungen des Kreditwesengesetzes, insbesondere der erweiterte Kreditbegriff des § 19 KWG, die Regelungen der Kreditbestimmungsverordnung und die Miüionenkreditbestimmungen sowie die Konsolidierungsvorschriften der §§10a und 13a KWG wird der Verfasser in Beiträgen in den folgenden Heften der ZBB behandeln.
