Langfristige Bankverträge und die Euro-Währung

Abstract

Zum 1. Januar 1999 soll die dritte Stufe der europäischen Wirtschafts- und Währungsunion in Kraft treten und zugleich eine eigenständige europäische Währung in den Teilnehmerstaaten eingeführt werden. Das im EG-Vertrag vorgesehene Datum wurde von den Staats- und Regierungschefs der Mitgliedstaaten der Europäischen Union bei ihrem Gipfel Mitte Dezember 1995 bekräftigt. Die Einführung der Euro-Währung stellt eine enorme ökonomische und technische Herausforderung dar, für die Vergleichsbeispiele zur Orientierung fehlen. Die Beantwortung der hiermit verbundenen Rechtsfragen ist schon wegen der damit verknüpften wirtschaftlichen Auswirkungen bedeutsam. Sie muß sowohl dem System unserer Rechtsordnung als auch den praktischen Anforderungen gerecht werden. Wichtiger Anwendungsfall ist die Behandlung langfristiger Bankverträge beim Ubergang auf die Euro-Währung. Der nachfolgende Beitrag listet diesbezügliche Fragestellungen, insbesondere zur For führung der Verträge, auf und beschreibt aus Sicht der Praxis dringlich zu diskutierende Lösungsmöglichkeiten
