Der Regierungsentwurf zum KapMuG und die Hypertrophie des Sonderverfahrensrechts

Abstract

Am 13. 3. 2024 hat die Bundesregierung den Entwurf eines Zweiten Gesetzes zur Reform des Kapitalanleger-Musterverfahrensgesetzes (KapMuG) vorgelegt. Damit soll das KapMuG in einer überarbeiteten Fassung dauerhaft im deutschen Zivilverfahrensrecht etabliert werden. Der Autor stellt den Regierungsentwurf in den größeren Kontext der Entwicklung des kollektiven Rechtsschutzes und bedauert, dass der deutsche Gesetzgeber sich damit weiterhin in der Pfadabhängigkeit der Entwicklung zahlreicher Sonderverfahrensrechte (KapMuG, VDuG, UKlaG, UWG, GWB) befindet, die jeweils unterschiedliche Regelungen zum kollektiven Rechtsschutz enthalten. Innerhalb dieser Pfadabhängigkeit enthält der Gesetzentwurf einzelne Veränderungen und punktuelle Verbesserungen, die im Beitrag erörtert und kommentiert werden.
