Digitales Geld für die digitale Welt – Der Verordnungsvorschlag der Europäischen Kommission zur Einführung eines digitalen Euro

Abstract

Im Juni 2023 präsentierte die Europäische Kommission das sog. Single Currency Package, dessen Kern der Vorschlag für eine Verordnung zur Einführung eines digitalen Euro (COM[2023] 369 final) bildet. Die damit forcierte Einführung von digitalem Zentralbankgeld lässt die rechtlichen Konturen des digitalen Euro klarer werden, womit der europäische Gesetzgeber sich anschickt, den Grundstein für ein neues Kapitel europäischer Geldgeschichte zu legen. Das Legislativpaket ist daher Anlass und Ausgangspunkt, die Genese von digitalem Zentralbankgeld speziell für die Eurozone näher zu beleuchten und den Verordnungsvorschlag einer ersten Analyse zu unterziehen mit dem Ziel, rechtlich kontroverse Aspekte zu adressieren. Zwei Kernfragen sind dabei handlungsleitend: Erstens, was sind taugliche Rechtsgrundlagen für eine europäische Digitalwährung? Zweitens, was folgt aus dem Design für die Rechtsnatur des digitalen Euro und damit letztlich auch für die Rolle der EZB?
