Abstract

Die Vermögensanlage privater Haushalte befindet sich im Wandel. Insbesondere die fortschreitende Digitalisierung und die zunehmende Zahl an Selbstentscheidern haben in den letzten Jahren neue Anbieter und Geschäftsmodelle geschaffen, die etablierte Konzepte in der Vermögensanlage herausfordern. Eine zentrale Rolle spielen Neobroker, die ihren Kunden eine einfache, intuitive und kostengünstige Partizipation am Kapitalmarkt versprechen. Der vorliegende Artikel beleuchtet in diesem Zusammenhang den Einsatz von Praktiken zur Incentivierung der Interaktion des Kunden mit dem Broker, sog. Digital Engagement Practices (DEPs). Hierzu erfolgt zunächst eine kritische Einordnung von DEPs vor dem Hintergrund potenziell unterschiedlicher Interessen von Investoren und Neobrokern. Darüber hinaus werden auf Basis aktueller Erkenntnisse aus der verhaltenstheoretisch fundierten finanzwirtschaftlichen Forschung (Behavioral Finance) die Konsequenzen des Einsatzes von DEPs erörtert. Abschließend erfolgt eine rechtliche Einordnung anhand der aktuellen Gesetzeslage und ein Blick auf künftige Herausforderungen in der Gesetzgebung.
