Unabhängigkeit der Finanzmarktaufsicht

Abstract

Das deutsche Modell einer ministeriell gesteuerten Verwaltung gerät zunehmend unter Druck. Denn im europäischen und internationalen Vergleich ist der Typus der „independent agency“, die allein dem Parlament verantwortlich ist, weit verbreitet. Nachdem das Unionsrecht schon die politische Unabhängigkeit der mitgliedstaatlichen Datenschutzaufsicht und der Bundesnetzagentur erzwungen hat, erteilte nunmehr das BVerfG in seinem Urteil zur Bankenunion der unionsrechtlich geforderten Entlassung der BaFin in den ministerialfreien Raum seinen verfassungsrechtlichen Segen, soweit die Bundesanstalt im Rahmen des Einheitlichen Europäischen Aufsichts- und Abwicklungsmechanismus tätig ist. Der Beitrag analysiert die unions- und verfassungsrechtlichen Vorgaben zur Rechtsstellung der europäischen und deutschen Finanzmarktaufsichtsbehörden und bewertet die Leistungsfähigkeit der divergierenden Modellannahmen. Im Ergebnis plädiert er dafür, die BaFin vollständig von der Rechts- und Fachaufsicht durch das Bundesfinanzministerium zu befreien.
