Die geplante „European Green Bond“-Verordnung und ihre (international-)privatrechtliche Durchsetzung

Abstract

Mit der aktuell diskutierten Verordnung über europäische grüne Anleihen will die EU auf dem Markt für Green Bonds größere Rechtssicherheit schaffen. Die Durchsetzung der geplanten Verordnung wirft aber Fragen auf. Die Verordnung soll einen freiwilligen Standard für „European Green Bonds“ mit potenziell globaler Reichweite aufstellen. Sie sieht selbst keine privatrechtlichen Ansprüche vor. Anleger können jedoch bei zweckwidriger Verwendung der Emissionserlöse nach dem jeweils anwendbaren nationalen Recht vertragliche und vorvertragliche Ansprüche ebenso wie Ansprüche aus Kapitalmarkthaftung geltend machen.
