Abstract

Mit der Leerverkaufsverordnung hat der europäische Gesetzgeber im Jahre 2012 auf die unterschiedlichen nationalen Maßnahmen im Zuge der Finanzkrise 2008 reagiert. Passend zum zehnjährigen Jubiläum im Jahr 2022 veröffentlichte die ESMA einen „Final Report“ zur Leerverkaufsverordnung. Der Beitrag nimmt dies zum Anlass, die bisherige Bedeutung der Leerverkaufsverordnung für die Praxis darzulegen und die Regelungssystematik sowie die aktuellen Entwicklungen zu evaluieren.
