Abstract

Durch die Rechtsstreitigkeiten um Zinspassungen bei langfristigen Prämiensparverträgen ist in Deutschland zuletzt die Lückenfüllung bei unwirksamen Vertragsklauseln in den Fokus der vertrags- wie bankrechtlichen Debatte gerückt. Der nachfolgende Beitrag gibt – in Anknüpfung an Omlor, ZBB 2020, 355 (zur deutschen Rechtslage) – einen rechtsvergleichenden Überblick zu den damit zusammenhängenden Rechtsfragen für den anglo-amerikanischen (England, USA/New York), den romanischen (Frankreich, Italien) und den deutschen Rechtskreis (Österreich, Schweiz).
