Abstract

Eine der zentralen Pflichten des Vermögensverwalters ist die Pflicht zur Rechenschaftsablage. In diesem Beitrag geben wir zunächst einen Überblick über deren Rechtsgrundlagen im schweizerischem Zivil- und Finanzmarktaufsichtsrecht. Anschließend stellen wir Querbezüge zwischen diesen beiden Rechtsgrundlagen sowie der Rechenschaftspflicht gemäß Kollektivanlagerecht und dem in der Praxis bedeutsamen datenschutzrechtlichen Auskunftsrecht her. Abgerundet wird der Beitrag mit einigen generellen rechtsvergleichenden Bemerkungen sowie ebenfalls rechtsvergleichenden Ausführungen zu ausgewählten Einzelfragen.
