Anforderung an das Verbot der Marktmanipulation in illiquiden Märkten

Abstract

Mit der vorliegenden Entscheidung des EFTA-Gerichtshofs hat sich erstmals ein europäisches Gericht zur Auslegung der Vorschriften zum Verbot der Marktmanipulation nach Art. 1 Abs. 2 Marktmissbrauchsrichtlinie (2003/6/EG) geäußert. Dass es sich dabei nicht um den EuGH, sondern um den EFTA-Gerichtshof handelt, mag auf den ersten Blick etwas gewöhnungsbedürftig sein, ändert aber nichts an der Relevanz für die Auslegung der Marktmissbrauchsrichtlinie und auch der diese ersetzenden Marktmissbrauchsverordnung (MAR), da die Regelungen zur Marktmanipulation nahezu unverändert in deren Art. 12, 15 übernommen wurden.
