Das Fondsstandortgesetz im Kontext des europäischen Wettbewerbs der Fondsstandorte

Abstract

Mit dem Entwurf eines „Gesetzes zur Stärkung des Fondsstandorts Deutschland und zur Umsetzung der Richtlinie (EU) 2019/1160 zur Änderung der Richtlinien 2009/65/EG und 2011/61/EG im Hinblick auf den grenzüberschreitenden Vertrieb von Organismen für gemeinsame Anlagen“ vom 12. 1. 2021 verfolgt die Bundesregierung die Ziele, Wettbewerbsnachteile des deutschen Fondsstandorts im Vergleich zu anderen europäischen Fondsstandorten auszugleichen, das Innovations- und Wachstumspotenzial der deutschen Wirtschaft, insbesondere im Bereich der Startups, durch Steuererleichterungen zu steigern und die Richtlinie (EU) 2019/1160 zur weiteren Harmonisierung des grenzüberschreitenden Vertriebs von Investmentfonds in deutsches Rechts umzusetzen. Der vorliegende Beitrag stellt die wesentlichen Inhalte des Regierungsentwurfs dar, ordnet ihn in die bisherigen Bemühungen des Gesetzgebers um den deutschen Fondsstandort ein, bewertet ihn vor dem Hintergrund des globalen Wettbewerbs der Fondsstandorte und zeigt weiteren Handlungsbedarf auf.
