Abstract

Der BGH hat Ende 2020 grundsätzliche Feststellungen zur Haftung beim sog. CEO-Fraud und zum Begriff des Zahlungs(authentifizierungs)instruments getroffen. Gleichzeitig zeigt er auf, unter welchen Bedingungen Zahlungsdienstleister Kundenaufträge relativ rechtssicher auch per Fax annehmen können. Das Urteil dürfte deswegen Folgen für die Ausgestaltung von Kundenbedingungen im Zahlungsverkehr haben.
