Staatshaftungsrechtliche Implikationen des Wirecard-Skandals

Abstract

Im Zusammenhang mit dem Wirecard-Skandal sind die deutschen Aufsichtsbehörden in die Kritik geraten. Das deutsche System der behördlichen Bilanzkontrolle hat sich als weitgehend dysfunktional erwiesen. Insbesondere vor dem Hintergrund unionsrechtlicher Vorgaben können deshalb Staatshaftungsansprüche geschädigter Anleger bestehen. Neben Ansprüchen unmittelbar gegen die BaFin kommt eine Haftung der Bundesrepublik Deutschland sowohl für die fehlerhafte Umsetzung der Transparenz-RL durch den Bundesgesetzgeber als auch für Versäumnisse seitens der Bundesregierung, der BaFin und der Deutschen Prüfstelle für Rechnungslegung e. V. in Betracht.
