Folgenbeseitigungsansprüche aus § 8 UWG? – Eine kritische Betrachtung

Abstract

In Zeiten anhaltender Negativzinsen ist das Erwirtschaften von Entgelten für die Kreditinstitute weiterhin von wirtschaftlicher Bedeutung. Gleichwohl wird zurzeit rechtspolitisch und dem folgend durch einige gerichtliche Entscheidungen anhand des Beseitigungsanspruchs aus § 8 UWG ein zweifelhaftes Instrument des kollektiven Rechtsschutzes gegen unwirksame Entgeltklauseln entwickelt. Jene Klauseln stehen schon länger im Blickpunkt der Rechtsprechung – hinsichtlich ihrer Rechtmäßigkeit in AGB-Bestimmungen hat der BGH ein ausdifferenziertes Prüfprogramm entwickelt. Sowohl das OLG Dresden als auch die Vorinstanz haben nun auf Grundlage von § 8 Abs. 1 Satz 1 UWG einen Folgenbeseitigungsanspruch bejaht, der das beklagte Institut verpflichtet, unrechtmäßig vereinnahmte Entgelte an die betroffenen Verbraucher zurückzuzahlen.
