Negativzinsen im Einlagengeschäft

Abstract

Veranlasst durch die Geldpolitik der Europäischen Zentralbank gehen Geschäftsbanken im Eurogebiet zunehmend dazu über, Unternehmen und Verbrauchern Zahlungspflichten für die Entgegennahme von Anlagegeldern in Rechnung zu stellen. Das LG Tübingen hatte im Jahr 2018 als erstes deutsches Gericht gleich in drei unterschiedlichen Verfahren über die zivilrechtliche Zulässigkeit der Einführung von Negativzinsen im Einlagengeschäft mit Verbrauchern nach deutschem Recht zu urteilen. Diese ersten Judikate zu der Thematik sind Anlass, grundlegende Aspekte der Thematik noch einmal vertieft zu beleuchten.
