Neue Möglichkeiten für Zahlungsdienstnutzer im Recht der Zahlungsdienste nach Umsetzung der PSD II

Abstract

Durch die spätestens bis zum 13. 1. 2018 in nationales Recht umzusetzende Zweite EU-Zahlungsdiensterichtlinie (PSD II) wird das Recht der Zahlungsdienste nach Umsetzung der (Ersten) EU-Zahlungsdiensterichtlinie im BGB und Einführung des ZAG einer weiteren Überarbeitung unterzogen. Dabei wird auch eine Vielzahl an dem Verbraucher nützlichen zusätzlichen Regelungen eingeführt oder werden bestehende (überwiegend) zu seinen Gunsten modifiziert. Im Recht der Bundesrepublik Deutschland erfolgt dies durch das Gesetz zur Umsetzung der Zweiten Zahlungsdiensterichtlinie (ZDUG). Dieses Gesetz vom 17. 7. 2017, das am 21. 7. 2017 verkündet worden ist, wird die Anforderungen der PSD II daher fristgemäß in deutsches Recht umsetzen. Die in ihm enthaltenen Änderungen sollen im Weiteren unter dem Gesichtspunkt der Verbesserung der Position des Verbrauchers dargestellt werden. Die PSD II stärkt die Rechtsposition des Verbrauchers und führt neue Institute ein, die ihm zusätzliche Serviceleistungen zur Verfügung stellen.
