Abstract

Die Bankenregulierung kennt in § 25a Abs. 5 KWG eine Obergrenze für die variable Vergütung der Mitarbeiter und Geschäftsleiter der Institute. Der Fondsbranche ist eine derartige Deckelung fremd. Ein Konflikt zwischen diesen beiden Regelungssystemen ist in Gruppensachverhalten vorprogrammiert. Dieses Spannungsverhältnis wird von der neuen, am 4. 8. 2017 in Kraft getretenen Institutsvergütungsverordnung 2017 (InstitutsVergV 2017) aufgegriffen. In ihrem § 27 InstitutsVergV 2017 sieht sie gruppenweite Regeln für die Vergütung vor, deren Berechtigung und Reichweite in diesem Beitrag erhellt werden sollen.
