Abstract

Zu den wichtigsten Neuerungen der Marktmissbrauchsverordnung im Bereich des Insiderrechts gehört die Normierung „legitimer Handlungen“, also die gesetzliche Fixierung bestimmter Ausnahmefälle, in denen der Erwerb oder die Veräußerung von Finanzinstrumenten trotz Kenntnis einer Insiderinformation nicht gegen das Insiderhandelsverbot verstößt. Der vorliegende Beitrag erörtert den historischen, teleologischen und ökonomischen Hintergrund dieser Regelung und geht auf die wichtigsten Anwendungsfragen ein.
