Kenntnisabhängige Verjährung nach fehlerhafter Anlageberatung oder: was man als Anleger so alles zu wissen hat

Abstract

Die kenntnisabhängige Verjährung im Recht der Haftung für fehlerhafte Aufklärung und Beratung von Anlegern durch Bankberater ist in der jüngeren Vergangenheit durch verschiedene Entscheidungen in den Mittelpunkt des Interesses gerückt. Das Bankrecht legt die Schwächen des neuen Konzepts der Regelverjährung schonungslos offen. Dieses hat den Spezialfall des § 852 BGB a. F. verallgemeinert, ohne die Implikationen und Konsequenzen ausreichend zu berücksichtigen. Auch die ober- und höchstrichterliche Rechtsprechung scheint sich noch nicht ganz darüber im Klaren zu sein, von welchem Standpunkt aus sie mit den vielfältigen Fragen von Kennen und Kennenmüssen im Bereich der Haftung für schlechte Beratung umgehen soll. Der Beitrag möchte dafür einige Überlegungen bereitstellen, erörtert offene Fragen, die zum Teil bereits vor dem BGH anhängig sind und verlangt de lege ferenda eine Beschränkung der kenntnisabhängigen Verjährung auf die Fälle, für die sie sich tatsächlich eignet.
