Bankenabwicklung nach dem SAG

Abstract

Mit den Neuregelungen zur Sanierung und Abwicklung von Banken (BRRD, SRM-VO und SAG) ist das Bankeninsolvenzrecht auf eine einheitliche Grundlage gestellt worden. Der praktische Wert der eingeführten Abwicklungsmaßnahmen, insbesondere des sog. bail-in, muss sich indes noch beweisen. Nachdem sich die wissenschaftliche Diskussion bisher auf die grundsätzlichen rechtspolitischen Fragen fokussiert hat, ist es nunmehr an der Zeit, die komplexen Neuregelungen auch in ihren Details stärker zu untersuchen. Der Beitrag unternimmt es, die im SAG vorgesehenen Abwicklungsmaßnahmen vorzustellen und erste konkrete Auslegungs- und Zweifelsfragen der gesetzlichen Regelungen zu identifizieren.
