Die Verjährung im Anlegerschutzrecht

Abstract

Im Dezember 2011 hat eine Klagewelle die deutschen Gerichte und Gütestellen überflutet. Enttäuschte Anleger wollten ihre Investitionsentscheidungen rückgängig machen und haben den Zeitpunkt nicht rein zufällig gewählt: Nach dem seit 2002 geltenden Verjährungsrecht mussten Anleger, die in den 1980er und 1990er Jahren investiert haben, ihre potentiellen Ansprüche spätestens zum Ende des Jahres 2011 aktiv verfolgen, um sie nicht faktisch zu verlieren. Inzwischen erreichen immer mehr Verfahren die Berufungs- und Revisionsinstanzen, so dass die Anzahl der veröffentlichten Entscheidungen erheblich gestiegen ist. Der Beitrag ordnet systematisch die jüngst ergangenen Judikate und setzt sich mit ihnen vertieft auseinander.
