Anlageberatung nach der MiFID II

Abstract

Am 13. 5. 2014 hat der Europäische Rat den Text der MiFID II angenommen. Auch wenn die Regelungen noch in nationales Recht umgesetzt werden müssen und im Wesentlichen erst ab 3. 1. 2017 zu berücksichtigen sind (Art. 92 Abs. 1 Satz 3 MiFID II), sollten sich die Rechtsanwender bereits jetzt mit den einzelnen Bestimmungen auseinandersetzen. Dabei zeigt sich, dass immer wieder Unsicherheiten darüber bestehen, wie die Vorgaben in nationales (Aufsichts-)Recht transformiert werden. Fest steht aber jetzt schon, dass die Richtlinie zu weitreichenden Änderungen des Wertpapierhandelsrechts führen wird.
