Abstract

Am 23. 5. 2014 veranstaltete die Forschungsstelle Bankrecht an der Universität Münster unter Leitung von Prof. Dr. Matthias Casper den 5. Münsteraner Bankrechtstag. Thematisch beschäftigte sich der Bankrechtstag mit der Wirksamkeit von Bearbeitungsentgeltklauseln in Verbraucherdarlehensverträgen sowie mit der Frage der Einheitlichkeit der Bankenaufsicht durch die EZB und ihren Auswirkungen auf den Sparkassen- und Genossenschaftssektor. Auch wurde ein Blick auf die verschärften Anforderungen der MiFID II an die Anlageberatung gerichtet. Diskutiert wurde des Weiteren über die Erstreckung der Unterwerfung in die sofortige Zwangsvollstreckung auf den Zessionar der Grundschuld und die Auslegung der zuständigen BGH-Senate. Abschließend lag der Fokus des Bankrechtstags auf dem Zahlungsdiensteaufsichtsgesetz (ZAG) und einigen Anwendungsproblemen der ersten fünf Jahre seines Bestehens.
