Boni für Bankiers – Regulierungsauftakt durch das Reichsgesetz über das Kreditwesen (RKWG)

Abstract

Die Praxis der erfolgsabhängigen Vergütung von Bankiers trat nach der Bankenkrise 2007 in den Fokus der Öffentlichkeit, denn trotz sinkender Gewinne erhielten Bankiers Boni in unverhältnismäßigem Umfang. Die daraufhin ergriffenen legislativen Maßnahmen waren nicht der erste Versuch, Bonuszahlungen in Deutschland zu regulieren. Bereits nach der Bankenkrise 1931 strebte man eine Regulierung an. Dieses Streben schlug sich im § 15 RKWG nieder. Die Vorschrift sollte als Lehre aus der Bankenkrise fortan das Verantwortungsbewusstsein von Geschäftsleitern einer Bank mithilfe der Errichtung eines Haftungsfonds materiell steigern. Im Ergebnis zeigen sich zwiespältige Anreizwirkungen und eine eingeschränkte Haftungsqualität der einbehaltenen Anteile am Geschäftsergebnis.
