Die Regulierung der Vergütung von Fondsmanagern – zum Umgang mit Copy-paste-Gesetzgebung nach der Finanzkrise

Abstract

Der europäische Richtliniengeber hat eine für Banken entworfene Vergütungsregulierung mehr oder minder textgleich auf die Investmentbranche übertragen. Der Beitrag geht der Frage nach, welchen sinnvollen Zielen eine derartige Regulierung bei Fondsverwaltern dienen kann. Dazu wird die theoretische und empirische Forschung zu Risikoanreizen bei Wertpapier-Publikumsfonds sowie Hedgefonds umfassend ausgewertet. Ferner wird untersucht, inwieweit die neuen Regelungen das festgestellte Regulierungsbedürfnis erfüllen können.
