Banken und Insolvenz - eine internationale Betrachtung

Abstract

Das in diesem Beitrag thematisierte Spannungsverhältnis weist Inhaltsübersicht zwei Seiten auf: einmal die Insolvenz des Kunden der Bank und zum anderen die Insolvenz der Bank selbst. Letzteres wird literarisch wenig erörtert - und noch weniger seine internationalen Implikationen. Das ist deswegen verwunderlich, weil der Europäische esetzgeher jüngst erst eine Richtlinie eigens zur Regelung von Insolvenzen von Banken geschaffen hat, die gegenüber der ungleich bekannteren und häufig behandelten Europäischen Insolvenzverordnung entscheidende Abweichungen des zugrunde liegenden Regelungsmodells aufweist. Anhand einiger exemplarischer Ausgangsfragen des nationalen Rechts werden diese Abweichungen dargestellt und auf ihre wechselseitige Anpassungsfähigkeit überprüft.
